What happened
Excalibur Ventures brought a $1.6 billion claim to a share of Kurdish oil field proceeds, alleging a joint venture with the defendant. The documentary evidence advanced in support of the claim was subjected to forensic scrutiny and found to be inconsistent with metadata and contemporaneous records. Christopher Clarke J found the claim to be speculative and the documentary foundation unreliable. The claim was dismissed in its entirety. The court awarded indemnity costs of approximately £22 million, and in a significant subsequent ruling, the litigation funders who had backed the claim were held jointly liable for those costs alongside Excalibur, a ruling that drew widespread attention in the litigation funding market.
